Suspect denies murder and rape of Hannah Windsor at Liverpool court

An 18 year-old man has admitted unlawfully killing his girlfriend at a secluded beauty spot but denies murder and two counts of rape.

Baby-faced Adam Lewis pleaded not guilty despite his defence counsel declaring that it “may be difficult to convince the court” of his innocence.

Crop-haired, wearing a grey prison issue tracksuit, the teenager appeared via videolink from HMP Altcourse at Liverpool Crown Court fidgeting throughout a 30-minute hearing.

Mr Paul Wood QC, defending, said: “We await a psychiatric report because it is clear he wasn’t acting as an adult of his age would.

“He intends to plead not guilty to the count of rape and murder, however, it may be hard for him to convince the court he is not guilty.”

Prosecuting counsel Anya Horwood QC rejected the not guilty pleas and said they “are not acceptable”.

As well as two counts of rape and murder Lewis is charged with burglary and arson with intent to endanger life relating to an incident at a house of a man in Moreton.

He pleaded guilty to the lesser chargers and Recorder of Liverpool Clement Goldstone QC told him the date for his trial was fixed for 19th November.

Standing from his seat Lewis replied: “Thank you.”

Murder accused Lewis, of Fairmead Avenue, Moreton, was arrested hours after the body of 17 year-old Hannah Windsor was found on Bidston Hill on Wirral on 20th May.

Police found her corpse in undergrowth yards from a historic Grade II listed observatory which stands in a vast woodland area popular with hikers and dog walkers.

A post mortem found she died from multiple injuries, including being stabbed,and strangled.

Staff from the assisted accommodation where tragic Hannah lived with her family in Birkenhead reported her missing a week before the grisly discovery.

Austin, Minn., felon gets 15 years on weapons charge

A Minnesota man with suspected ties to white supremacist groups has been sentenced to 15 years in prison for possessing an assault rifle.

U.S. District Judge Richard Kyle on Wednesday sentenced 31-year-old Samuel James Johnson of Austin on one count of being a felon in possession of a firearm.

Johnson pleaded guilty in June. In his plea agreement, Johnson admitted he possessed a semiautomatic assault rifle on Nov. 4, 2010.

Because he is a felon, federal law bars Johnson from possessing firearms or ammunition at any time.

Johnson’s criminal history includes convictions in Mower County for attempted robbery, robbery, possession of a short-barreled shotgun and sale of a simulated controlled substance.

Prosecutors say that because of his record, Johnson faced a minimum of 15 years in federal prison.

Judge orders drunk driver to read Bible’s tale of Job

Really interesting constitutional questions raised by a woman who pleaded guilty to driving while intoxicated being sentenced to eight years in jail, five years probation and substance abuse counseling. It’s none of those conditions that raise the constitutional concern. It’s this:

The South Carolina judge also ordered Cassandra Tolley to read the Old Testament book of Job and write a little book report on it.

“Under normal circumstances, the judge wouldn’t have the authority to do that,” said Kenneth Gaines, a University of South Carolina professor of law specializing in civil and criminal litigation. “You can’t just arbitrarily add anything you want to a sentence.

“But if she consented, it’s really not an issue. It’s critical that the defendant was in entire agreement with it.”

Tolley’s attorney, Amy Sikora, a York County public defender, said Tolley was thankful for the assignment. She has already started working on it.

But I’m not certain that is enough to overcome the constitutional concerns.

Regardless of whether Tolley consents to the judge’s sentence, the sentence still represents state action and thus implicates the First Amendment. And the sentence might run afoul of the First Amendment by being a government endorsement of religion (generally, though probably not specifically because Job is a shared book) and by entangling government in a religious function—after all, the judge will need to read and evaluate Tolley’s summary of the book, right?

43 years for murdering gogo

Senzo Nhlabatsi of Fumbizinhlwa, a community under Hlathikhulu in the Shiselweni region, was convicted and sentenced by High Court Judge Bheki Maphalala. He was convicted together with Wandile Dlamini who was sentenced to 25 years for the murder charge only.

Judge Maphalala sentenced Nhlabatsi to 25 years imprisonment for the murder of Mary Ginindza on suspicion that she had bewitched their family. He sentenced him to 18 years for the rape and directed that the sentences should run consecutively.

The two had pleaded guilty to the offences.

They alleged that they suspected Ginindza had a hand in the deaths of Dlamini’s father and brother.

They alleged that when they confronted her she confessed.

The alleged confession came after severe beatings with a sjambock from the two on August 22, 2010. She is also alleged to have confessed to having killed her own husband.

Dlamini and Nhlabatsi, who are cousins, are said to have decided it was enough and approached thewoman. They assaulted her with a sjambok and an assortment of weapons until she lost strength. Nhlabatsi is said to have then raped her and tried to conceal it. They then made a fire and lit a tyre which they placed on her body.

 Maphalala said there was no scientific way to prove witchcraft. He said a lot of people had lost their lives, even when they had not committed witchcraft, but just because neighbours believed they had done it. “Everyone has a constitutional right to life,” he said.

Man gets 2 life sentences for raping in Ga. church

A judge has sentenced a 51-year-old man to two consecutive life sentences for raping a woman in a suburban Atlanta church this year.

The Atlanta Journal-Constitution ( http://bit.ly/KIkkfb) reports that Judge Asha Jackson also sentenced John Russell Carver to 115 years behind bars. Carver pleaded guilty Friday to raping a female employee of Timothy United Methodist Church in Stone Mountain in February.

 

Jackson says Carver beat the 53-year-old woman, stomped on her head and raped her while bearing a knife. She was alone inside the church when the incident occurred.

The judge called Carver’s act “extremely violent and vicious.”

Man sentenced for hate crime

One of two men indicted in March on a hate crime charge has pleaded guilty and been sentenced to four years in prison with a recommendation for the impact incarceration, or boot camp, program.

Prison boot camp is a four-month, structured rehabilitation program that, if successfully completed, can replace prison time.

As part of his guilty plea, an aggravated battery charge was dismissed against Robert Hunt, 18, of the 1300 block of East Black Avenue.

Anthony Ishmael, 18, of Williamsville also is charged with a hate crime and misdemeanor aggravated assault in connection with a Feb. 8 incident involving a Lanphier High School custodian.

Hunt and Ishmael allegedly approached a Lanphier custodian as he was salting a school parking lot at 11th Street and Converse Avenue about 7:30 a.m. Feb. 8.

The victim, who is black, told police that as he walked back toward the school with his equipment, three men approached and that one, allegedly Hunt, punched him in the back of the head and made a racial remark to him.

The custodian called for school security, and the attacker asked if he was calling the police.

When the custodian replied that he was, the three men surrounded him, and a second man, allegedly Ishmael, swung a fist at the custodian but missed.

The custodian said he pulled a pocketknife to defend himself, and the men ran.

Assistant state’s attorney Karen Tharp prosecuted the case. Hunt was represented by Springfield attorney Ryan Cadagin.

Ishmael’s case is set for trial June 25.

Florida student to plead guilty to Obama threat

Court records show a Miami college student intends to plead guilty to making threatening posts against President Barack Obama on Facebook.

A change of plea hearing is set Wednesday for 20-year-old Joaquin Amador Serrapio Jr. He had previously pleaded not guilty.

Federal prosecutors say Serrapio posted threats on Facebook in February coinciding with a speech Obama gave at the University of Miami. Serrapio attends a different school, Miami-Dade College.

One post threatened to put a bullet in the president’s head. Another asked if anyone wanted to help with a presidential assassination.

There’s no indication Serrapio intended to act on the threats. His lawyer has said Serrapio never wanted to hurt the president. The lawyer didn’t immediately respond to an email Thursday.

Serrapio faces a maximum five-year prison sentence.

Patterson Gets Life for Murder of Eric Forrester

A Tarrant County jury has sentenced Broderick Patterson to life in prison for the murder of 17-year-old Eric Forrester.

After the sentence was read, Patterson shouted expletives at the jury to the shock of those in the courtroom.  The reaction startled many since Patterson plead guilty to the 2010 crime and said he’d let the jury decide his punishment.

Patterson’s family was also very upset after the sentence was read and an aunt blamed the Texas juvenile justice system for not reaching the troubled teen before the robbery and murder took place.

On Tuesday, jurors heard the 911 call placed by the victim, who then put the phone in his pocket. In the recording, police hear one man yelling at Forrester to get a bag, presumably to carry the items being taken.  A short time later, the men can be heard yelling at Forrester before a gunshot is heard followed by an exclamation of shock by one of the two people.

Aryan Brotherhood member sentenced for slaying

A member of the white supremacist Aryan Brotherhood of Texas prison gang has been sentenced to life imprisonment after pleading guilty to helping to torture and kill a Pleasanton man.

A Justice Department statement says a federal judge in San Antonio sentenced Michael Dewayne “Bucky” Smith of Vidor (VYE’-dur) on Wednesday. He pleaded guilty to murder and conspiracy in the racketeering-related death of Mark Davis Byrd Sr. A fellow gang member, Jim Flint “Q-Ball” McIntyre of Houston, is serving a life sentence after pleading guilty to the same charges.

 

Gang captain Frank Lavelle “Thumper” Urbish Jr. of Beaumont awaits sentencing after pleading guilty to the same charges. He, too, could get life.

 

Court documents show Byrd was killed for stealing drugs he was to deliver for the gang.

Bucks man pleads guilty in kidnapping scheme

A Bucks County man pleaded guilty Friday to soliciting an undercover FBI agent, who was posing as a white supremacist, to kidnap a New Jersey woman and her child, prosecutors said.

Jayen I. Patel, 41, of Southampton, pleaded guilty to one count of soliciting an individual to aid in a kidnapping. Patel, who faces a maximum of 20 years in prison, entered his plea before U.S. District Judge Freda L. Wolfson in federal court in Trenton.

In 2010, Patel contacted the undercover agent through a social-networking website. Patel eventually revealed a plan to kidnap the woman and her child on behalf of the woman’s ex-husband so he could gain custody of the child. Patel would then keep the woman as a slave.
